These Terms of Use govern your use of the ExitPath: Emergency Lighting mobile application ("the App") published by D4N LTD ("we", "us", "our"). By downloading or using the App, you agree to these terms.

Licence

The App is licensed to you under Apple’s Standard Licensed Application End User License Agreement (EULA). These Terms of Use add to the EULA. If anything here conflicts with the EULA, the EULA applies.

What the App Does

ExitPath is a record-keeping tool for emergency lighting log books, based on BS 5266-1. It helps you keep the records BS 5266-1 recommends: a light register, monthly and annual tests, failures and retests, service visits and other events, with a PDF export of your log book.

BS 5266-1 is a British Standard published by BSI. ExitPath and D4N LTD are not affiliated with or endorsed by BSI.

Your Responsibilities

ExitPath is a record-keeping aid only. It does not test, inspect, service or sign off an emergency lighting system, and it does not replace the periodic inspection and test certificate from your emergency lighting engineer. You remain responsible for:

  • Making sure tests, servicing and other work are carried out properly and by suitably qualified people
  • The accuracy and completeness of everything you enter
  • Checking your records against the current edition of BS 5266-1, your fire risk assessment and any advice from your emergency lighting engineer, insurer or enforcing authority
  • Keeping your own copies of your records, for example by exporting PDFs regularly

Using the App does not by itself meet any duty you have under fire safety law, including the Regulatory Reform (Fire Safety) Order 2005.

Reminders depend on iOS and your notification settings and may not always appear. Do not rely on the App as your only reminder of when tests or servicing are due.

Free Version and ExitPath Pro

The App is free to download. The free version covers one building with full logging, reminders, PDF export and iCloud sync across your devices. ExitPath Pro adds unlimited buildings, archiving of old buildings, and your company name, logo and contact details on PDFs.

ExitPath Pro is available as:

  • ExitPath Pro Yearly: £14.99 per year, an auto-renewing subscription, with a 7-day free trial for eligible new subscribers
  • ExitPath Pro Lifetime: £44.99, a one-time purchase that does not renew

Prices are in pounds sterling and include VAT where applicable. Prices in other countries are set by the App Store and shown before you buy.

Subscriptions and Auto-Renewal

  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • The yearly subscription automatically renews unless it is cancelled at least 24 hours before the end of the current period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current period, at the then-current price.
  • If you start a free trial, you will be charged when the trial ends unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • You can manage and cancel your subscription in your App Store account settings after purchase (on iPhone: Settings → [your name] → Subscriptions). Deleting the App does not cancel a subscription.
  • If we change the subscription price, Apple will tell you in advance and, where required, ask for your consent before the new price applies.

If Pro Ends

If your subscription ends, nothing is deleted. You choose one building to keep editing on the free version; your other buildings stay viewable and can still be exported to PDF.

Purchases, Restores and Refunds

All purchases are processed by Apple through the App Store and are subject to Apple’s terms. We do not process payments directly.

  • You can restore purchases on any device signed in with the same Apple ID using Restore purchase in the App
  • Refunds are handled by Apple under its refund policy. You can request one at reportaproblem.apple.com
  • Your rights as a consumer under UK law are not affected

Your Data

The records you create are yours. They are kept in the App and, if you use iCloud sync, in your own private iCloud account. See our Privacy Policy for details. PDF log books generated by the App are yours to use, share and keep with your fire safety records.

Intellectual Property

The App, its design, code and content are the property of D4N LTD. You may not copy, modify, distribute or reverse-engineer any part of the App, except as permitted by law.

Third-Party Services

The App uses the following Apple services:

The App contains no advertising and no third-party analytics.

Availability and Changes to the App

We may update, change or discontinue the App. If we discontinue it, the records already kept in the App stay available to you for as long as the App keeps working. You may stop using the App at any time by uninstalling it.

Limitation of Liability

Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded under the laws of England and Wales.

Subject to that, D4N LTD is not liable for any loss arising from missed, late or inaccurate tests, servicing or records, from reliance on reminders, or for any indirect or consequential loss. Our total liability to you in connection with the App is limited to the amount you paid for ExitPath Pro in the 12 months before the claim.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the jurisdiction of the courts of England and Wales, although if you live elsewhere in the UK you may also bring proceedings in your local courts.

Changes to These Terms

We may update these terms from time to time. Changes will be posted on this page with an updated date. Continued use of the App after changes means you accept the updated terms.
